PreambleThe website www.uneautrechambre.com (hereinafter referred to as "the Site") is owned and operated by BAILLY, a Société par Actions Simplifiée (SAS) with share capital of €1,908,874.00, registered in the Paris Trade and Companies Register under number B 948 596 630, with registered offices at 3 rue Bailly, 75003 Paris. Intracommunity VAT number: FR22948596630.\nFor any information, you can contact us:\n- by email: contact@uneautrechambreparis.com- by phone: +33(0)1.48.04.77.76In the context of these general terms and conditions of sale (hereafter "GTCS"), Hotel Une Autre Chambre and the customer are referred to together as the "Parties" and individually as a "Party".\nThese GTCS apply to all reservations made, whatever the customer's country of origin and whatever the currency used. Any reservation implies full acceptance of these GTC.\nHotel Une Autre Chambre reserves the right to modify these GTC at any time. The applicable terms and conditions are those in force on the date of confirmation of the reservation.\nARTICLE 1: GlossaryIn the present General Terms and Conditions of Sale, the terms below will have the following meaning:\n- Confirmation Email: Email sent by Hotel Une Autre Chambre at the end of the reservation or order process. It summarizes the elements of the reservation validated by the Customer and confirms receipt. This e-mail constitutes final confirmation of the reservation.\n-Reservation Confirmation: Electronic document summarizing the main characteristics of the services reserved by the Customer (type of room, dates of stay, additional services). Confirmation takes place after the Customer's bank details have been entered for payment or guarantee purposes, followed by final validation: Agreement formed between the Customer and the hotel Une Autre Chambre, covering the supply of services actually ordered by the Customer, including accommodation, any catering and ancillary services.\n- Customer: Any natural person of legal age, having full legal capacity, contracting on a personal basis for private or professional needs, and having made a reservation within the establishment.\n- Reservation Request: Manifestation of desire expressed by the Customer to reserve one or more rooms, made via mobile services, by internet, by telephone or by any other communication channel.\n- Mobile Services: All technologies allowing access to the internet from a mobile terminal (smartphone, tablet) to consult and reserve the services offered by the hotel Une Autre Chambre.\n- Online Reservation: Reservation operation carried out by the Customer directly on the website www.uneautrechambre.com, including the selection of services and the entry of personal and banking information.\n- Off-line Reservation: Reservation made other than on-line, in particular by telephone or e-mail, giving rise to a registration procedure in accordance with these General Terms and Conditions of Sale.\n- The Hotel: Refers to the establishment Une Autre Chambre, located at 3 rue Bailly, 75003 Paris, offering in particular temporary accommodation, catering and complementary services.\n- Services: All the services offered by the hotel Une Autre Chambre, in particular room rental, the provision of breakfasts, and any other service ancillary to temporary accommodation, the characteristics of which are specified on the website www.uneautrechambre.com, in accordance with article L. 111-1 of the French Consumer Code.\n- Extras: Optional services complementary to the main reservation, such as private transfers, gourmet breakfast, bottle of champagne, bouquet of flowers, etc., available for purchase before or during the stay.\n- Website: Electronic service operated by the hotel Une Autre Chambre, accessible at www.uneautrechambre.com, allowing in particular the consultation of offers and the reservation of services.\n- WAP: Communication protocol allowing access to the Internet via a mobile terminal, facilitating in particular the consultation and reservation of hotel services.\nARTICLE 2: Scope of application\n2.1 Extent\n2.1.1. These General Terms and Conditions of Sale (GTCS) apply, without restriction or reservation, to all services offered by the hotel Une Autre Chambre on its website www.uneautrechambre.com, by email and by telephone, in particular the reservation of rooms as well as additional services related to temporary accommodation.2.1.2. They govern all service reservation operations carried out by the Customer, whether online or via any other communication channel.\n2.2 TerritoryThe services presented on the site are intended to be provided exclusively at the Une Autre Chambre establishment, located at 3 rue Bailly, 75003 Paris, to the exclusion of any other location.\n2.3 Duration2.3.1. These General Terms and Conditions of Sale are applicable for as long as the services provided by Hotel Une Autre Chambre are available online at www.uneautrechambre.com.2.3.2. The hotel reserves the right to suspend or terminate, temporarily or permanently, access to its website or online reservation space, without notice or compensation.2.3.3. The hotel cannot be held responsible in the event of temporary or definitive unavailability of the website or reservation area, whatever the cause or duration.2.4 Legal status2.4.1. The present General Conditions are subject to the provisions of the French Consumer Code, in particular articles L.121-16 et seq.2.4.2. All bookings, whether made online at www.uneautrechambre.com or offline (by telephone or email), are subject to full acceptance of the present General Terms and Conditions, as well as the special pricing conditions applicable to each service.2.5 Purpose2.5.1. The purpose of the present General Terms and Conditions is to define the rights and obligations of the Parties in the context of the reservation of services offered by the hotel Une Autre Chambre.2.5.2. They govern all the stages necessary for the making, management, monitoring, modification and validation of reservations.3 : Capacity and acceptance of the Customer3.1 Absence of right of retractionThe Customer does not benefit from any right of retraction when purchasing a stay, whether On-line or Off-line. In accordance with article L. 221-28 12° of the French Consumer Code, the right of withdrawal does not apply to contracts for the provision of accommodation services, other than for residential purposes.\nAny request for cancellation will therefore be subject to the specific conditions of the reservation, which the Customer must consult beforehand.\n3.2 Legal capacityThe Customer declares that he/she has full legal capacity to enter into the contract, that he/she is of legal age under French law, and that he/she is not the subject of a legal protection measure, such as guardianship or curatorship.The Customer undertakes to use the Site in accordance with these General Terms and Conditions of Sale (GTCS), both for his/her own account and for that of the Beneficiaries of the services that he/she has ordered on the Hotel's Internet Site, in his/her capacity as agent (hereinafter the "Beneficiaries"). The Customer acknowledges that these General Terms and Conditions of Sale also apply to the Beneficiaries. The Customer assumes financial responsibility for the use of the Hotel Web Site, whether on his own behalf or on behalf of the Beneficiaries, unless he can prove that fraudulent use was made without fault or negligence on his part.\The Company reserves the right to refuse any contractual relationship with a Customer who makes fraudulent use of the Hotel's Internet site or who does not comply with these GTC.\We remind you that, in accordance with article 313-1 of the French Penal Code:\n "Fraud consists of deceiving a natural or legal person, either by using a false name or a false capacity, or by abusing a real capacity, or by resorting to fraudulent maneuvers, in order to determine to hand over funds, goods or a service, or to agree to an act producing obligations or discharges. Fraud is punishable by five years' imprisonment and a fine of €375,000."\nThe Hotel Une Autre Chambre reserves the right to request, upon the Customer's arrival, an official identity document including, in particular, the date of birth.\n3.3 Acceptance of the General ConditionsThe Customer acknowledges that the present General Conditions form an integral part of the contract concluded with the Hotel Une Autre Chambre.\n3.4 Presentation of contractual documentsThe Customer accepts that the General Conditions, the documents presenting the services and the specific rates, as well as the ordering procedures, are presented to him on line on the website www.uneautrechambre.com for the purposes of concluding the contract.3.5 Prior informationThe Customer declares that he has obtained, prior to any reservation validation, all the necessary information on the services offered, either via the website www.uneautrechambre.com, or from the staff of the establishment (by telephone, e-mail or in person).\n3.6 Consultation and acceptanceThe Customer acknowledges having read and accepted the present General Conditions as well as all the terms of the commercial proposal before finalizing his reservation.\nAny validation of a reservation, whether it is made On-line or Off-line, necessarily implies prior consultation and unreserved acceptance of the present General Conditions.\n3.7 Electronic signatureThe Customer expressly accepts that the entry of his/her banking information, acceptance of the General Conditions and validation of the reservation constitute an electronic signature within the meaning of article 1367 of the Civil Code (formerly article 1316-4), having, between the Parties, the same legal value as a handwritten signature.\n3.8 Personal use\nThe Customer declares that he is making any reservation for his personal needs and not for resale or subletting.\n3.9 Consultation and archiving\nThe Customer may consult, download and print these General Conditions at any time via the www.uneautrechambre.com website, notably in the dedicated "General Conditions of Sale" section.\n3.10 Completion of administrative documentsOn arrival, the Customer is required, on presentation of his or her identity document, to complete a registration form and, where applicable, an individual police form, in accordance with the provisions of article R. 611-42 of the Code de l'Entrée et du Séjour des Etrangers (French code governing the entry and residence of foreign nationals).ARTICLE 4: SITE CONTENT4.1 Information published on the siteThe site www.uneautrechambre.com website provides the following information:\nThe full identity of SAS BAILLY (company name, registered office address, e-mail address).\nThe essential characteristics of the accommodation offered:\n(available in the "Our Rooms & Suites" section, during the booking process via the availability calendar and the room selection).\nPlease note: photographs are non-contractual: the decoration, layout and dimensions of rooms may vary within the establishment.\The rates applied for each accommodation service and additional services.The payment methods accepted.The General Terms and Conditions of Sale.The period of validity of the offers and their rates.The minimum length of stay, if applicable.The absence of right of withdrawal and, if applicable, the cancellation terms.4.2. Languages availableThe site is available in French, English, Italian, German and Spanish.ARTICLE 5: BOOKING5.1. The Customer selects the services offered on www.uneautrechambre.com, with or without additional options ("Extras"), according to clearly displayed rates.The Customer acknowledges having read all the relevant information before booking.The Customer is solely responsible for the choice of services and their suitability for his or her needs. The Hotel cannot be held responsible in this respect.\nThe reservation is deemed accepted once the Customer clicks on "CONFIRM RESERVATION".\n5.2. Reservation processOn-line:\nSelection of dates, number of adults, children and babies.\nPossible entry of a promotional code.\nDisplay of availability.\nChoice of room, rates and possible Extras.\nDisplay of reservation summary.\Entry of personal information (identity, email, telephone, etc.).Validation of the General Terms and Conditions of Sale and the privacy policy.Possibility of indicating special requests (not guaranteed unless confirmed in writing by the Hotel).\Secure on-line payment and immediate confirmation with reservation number.\nOff-line:\nThe Hotel communicates to the Customer an offer with the rates for the services available and a link to access the General Terms and Conditions.\nThe Customer communicates to the Hotel, all the information required to create his/her reservation (Name, first name, e-mail address, telephone number, bank details)\nThe offers issued are valid for 24 hours.\n5.3. Formation of the contractThe contract is concluded :\n- When the reservation is confirmed by the Hotel with attribution of a reservation number.\n- After express acceptance by the Customer of the General Conditions of Sale and validation of his/her reservation.\nA confirmation e-mail is sent to the Customer, summarizing all the elements of the reservation.\n5.4. Right of withdrawal and cancellationNo right of withdrawal for dated accommodation services, in accordance with article L.221-28 of the French Consumer Code.\nCancellation of a reservation of one (1) to four (4) nights, at the Flexible rate:\nIn the event of cancellation of the reservation at the Flexible rate by the Customer, after its acceptance by the Hotel, less than 48 hours before the scheduled date of stay, for any reason whatsoever, a sum corresponding to the total amount of the 1st night (excluding Additional Service and Tourist Tax) will be automatically acquired by the Hotel and invoiced to the Customer, as damages, in compensation for the prejudice suffered.\nCancellation of a reservation of five (5) nights or more, at the Semiflex rate:\nIn the event of cancellation of the reservation at the Semiflex rate by the Customer, after its acceptance by the Hotel, less than 72 hours before the scheduled date of stay, for any reason whatsoever, a sum corresponding to 30% of the total amount of the stay (excluding Additional Services and Tourist Tax) will be automatically acquired by the Hotel and invoiced to the Customer, as damages, in compensation for the prejudice suffered.\Cancellation of a reservation at the Non-Refundable rate:In the event of cancellation or modification of the reservation at the Non-Refundable rate by the Customer, for any reason whatsoever, the sum corresponding to 100% of the total prepaid amount (excluding Additional Services and Tourist Tax) will be automatically acquired by the Hotel and invoiced to the Customer. The same shall apply in the event of the Customer's failure to arrive on the scheduled arrival date.5.5. Early DepartureIn the event of interruption of the stay, the amount of the night following the day of early departure will be invoiced, with no right to reimbursement or to any credit or exchange for the Customer as financial compensation for the prejudice.\nIn the event of reservation with payment during the reservation process, no reimbursement will be granted on this account.\n5.5. Late check-outUnless special arrangements have been made by the hotel, check-out must be before 12 noon. Beyond this time, a surcharge of €80/hour will be applied until 3pm. Thereafter, an additional night will be charged at the current rate.5.6. Reservations are personal and cannot be transferred.5.7. Additional comments:In the event of a dispute over a previous reservation, the Hotel may refuse any new reservation request from the same Customer.ARTICLE 6: RATES & PRICE CONDITIONS6.1. Prices are indicated before and during the reservation process.They are valid in real time according to the terms of article 5.2.For reservations made off-line (by telephone or e-mail), the rates communicated are valid at the time of the Customer's request and for a period of 24 hours.The specific pricing conditions applicable to each type of room or additional service are specified when the Customer chooses the service.6.2. Prices of services are established according to the economic conditions in force at the time the rates are defined, and are expressed in euros (€).\nThe Hotel reserves the right to modify prices at any time before confirmation of the reservation.\However, once the reservation has been confirmed, the price of the stay may not be modified until the date of departure.6.3. Prices are per room, for the number of people and for the date(s) selected.\nUnless a special supplement is paid, the stay includes by default:\n- Check-in from 3pm,\n- Check-out no later than 12pm.\On arrival, a bank pre-authorization in the amount of €150 and a valid form of identification will be required.\nIn the event of check-out not being carried out in the presence of the customer, the establishment reserves the right to debit the bank card left as an imprint during check-in.\n6.4. Applicable taxesPrices shown are in euros (€) and include all taxes, including VAT at the rate in force on the day of booking confirmation.Any change in the applicable VAT rate will be automatically reflected in the prices shown.6.5. Payments in foreign currenciesIf payment is made in a currency other than that of the country of establishment, any conversion or bank processing charges will be borne exclusively by the customer.6.6. Currency of paymentAll reservations are invoiced and payable in euros (€), unless expressly stated otherwise during the reservation process.6.7. Additional servicesUnless specifically mentioned, the additional services ("extras") selected by the Customer are not included in the initial price of the room.\nSome additional services validated at the time of booking may be payable immediately if the rate selected does not correspond to a Flexible rate.\nThese services are also subject to VAT at the rate applicable on the day of booking.\n6.8. Visitor's taxThe visitor's tax, set by the municipality of Paris, is applicable per day and per adult.\nIt is payable directly on site at the time of stay, and its amount is subject to change without notice.\n6.9. Any change in the rate of VAT applicable between the date of booking and the date of consumption of the stay (and additional services) will automatically be applied to the rates invoiced.6.10. Variation in rates according to exchange ratesWhere the rate must be paid on site in local currency, differences may arise from the rate initially communicated at the time of booking, due to variations in the exchange rate between the date of booking and that of the stay.\n6.11. Damage and theftAny missing object found in the room will be billed to the Customer at the current rate, available on request from reception.\nIn the event of damage to the room, common areas or equipment, the Hotel reserves the right to bill the Customer for the total cost of repairs and/or replacements required.\nARTICLE 7: PAYMENT7.1. The Customer provides his or her bank details as a guarantee for the reservation, except for special conditions or rates requiring online payment, as specified during the reservation process. Entry of payment information is secured by SSL encryption. In order to finalize the booking, the following information will be requested: card number, validity date, via the SystemPay by Lyra payment platform. This procedure also applies to offline bookings, which may require immediate payment or a deposit by credit card, depending on pricing conditions.7.2. Payment will be debited at the establishment during your stay, except for special conditions or rates where payment is made at the time of booking. In these cases, payment is made according to the contractual conditions previously accepted by the Customer.7.3. Credit card verificationThe service provider SystemPay by Lyra, chosen by L'Hôtel to secure online payments, verifies the validity of the Customer's credit card. If the card is refused for any reason whatsoever (stolen card, blocked card, ceiling reached, input error, etc.), the Customer must contact his/her bank to identify the source of the problem, and then contact the hotel to confirm the reservation and method of payment.7.4. Credit card guarantee for the flexible rate If the "Flexible Rate" simply involves a credit card guarantee being taken at the time of booking (online or offline), and payment is made to the establishment at the time of arrival or departure, the Hotel reserves the right to debit the amount corresponding to the first night's stay within two days of arrival.7.5. If the Customer books several rooms and online payment is only required for one room, the payment card used on the payment platform will be used to pay for the room in question, and will also be used as a guarantee for the other rooms.7.6. At check-in, a bank pre-authorization of €150 per room will be requested as a guarantee. This pre-authorization will not be debited, but may be used in the event of damage or non-payment. The pre-authorization will be cancelled after verification of the good condition of the room and accounts.7.7. Amount debited at the time of bookingAt the time of online payment, the amount debited includes the price of the accommodation and the corresponding taxes. The price of additional services or "extras" is payable on arrival or departure of the Customer.7.8. On-line payment for certain tariffsFor tariffs subject to on-line payment, the debit is made upon completion of the reservation by the Customer, via a secure computer process.\n7.9. Invoicing at the end of the stayAfter the stay, the Hotel will issue an invoice in duplicate. One copy will be given to the Customer on departure, either in hard copy or by e-mail, according to the Customer's choice.7.10. If the Customer's bill exceeds 1,000 Euros during his or her stay and payment has not been made online, the Hotel may require advance payment for the services provided during the stay, in accordance with the terms and conditions set out in this article.7.11. Refusal of payment by chequePayment by cheque is not accepted, whether for accommodation or for any other service or product provided by the Hotel to the Customer.\n7.12. Payment for additional servicesAny additional service or "Extra" reserved and delivered by the Hotel during the Customer's stay, and which has not been paid for in advance at the time of reservation, must be paid for no later than the day of departure.\nARTICLE 8: CLAIMS8.1. Guarantee of conformityThe Hotel is bound by the guarantee of conformity of services, under the conditions set out in article L. 111-2 of the French Consumer Code, without prejudice to any additional contractual guarantee that may be agreed in writing between the parties, outside these general conditions.8.3. Accuracy of informationThe Hotel makes every effort to ensure that the photographs, graphic representations and texts provided give as accurate an idea as possible of the services offered. However, the photographs are not contractual, as the different rooms, although all at the same price, may have different dimensions and variations in furniture, decoration or renovations. Unless a specific request for a particular room has been confirmed in writing, the customer may not make any claim concerning these variations, provided that they do not affect the essential characteristics of the service.8.4. Responsibility in the event of force majeureThe Hotel cannot be held responsible for the non-execution or poor execution of the reservation in the event of force majeure, an act of a third party, the Customer or its partners, such as the unavailability of the Internet network, the impossibility of access to the website, external intrusions, computer viruses, or in the event of on-line payment refused by the Customer's bank.8.5. Internet access Although the Hotel offers a wifi internet access service, in the event of total or partial failure of this service, not attributable to the establishment, during the stay, the Customer will not be able to cancel the reservation, obtain a refund or compensation.\n8.6. Liability for indirect damageThe Hotel will not be held liable for indirect or immaterial damage, such as loss of profit, operating loss, or any damage resulting from an act of a third party, the Customer or its partners.8.7. Hypertext linksHypertext links on the www.uneautrechambre.com website may lead to other sites. The Hotel cannot be held responsible for the content of these sites or the services they offer.8.8. The Customer agrees to use the room safe for all valuables and sums of money up to a value of 3,000 euros. Objects or sums of money worth more than 3,000 euros may be deposited in the hotel's central safe.8.9. In the event of a problem affecting the reserved room (such as unforeseen breakdowns, major damage or other urgent situations), the Hotel reserves the right to relocate the Customer to another establishment or another equivalent room within a reasonable period of time. The Customer will be informed as soon as possible and will be taken care of by L'Hôtel to minimize any inconvenience. The Hotel undertakes to offer a satisfactory alternative solution at no additional cost to the Customer, except in the event of exceptional circumstances.ARTICLE 9: MEDIATORIn accordance with the provisions of articles L. 611-1 and R. 612-1 et seq. of the French Consumer Code concerning the amicable settlement of disputes, when the consumer has sent a written complaint to the professional and has not received satisfaction or a response within two months, he may submit his complaint free of charge to the consumer mediator. Data collectionThe information requested during the secure reservation process is compulsory (indicated by an asterisk) to enable the Hotel, as data controller, and its service providers (payment, online reservation) to process the order, manage the customer file and send the newsletter.\nThe Customer may agree to receive special offers and information on new Hotel services by e-mail. The Customer may unsubscribe at any time by clicking on the dedicated link in the e-mail.\nThe information collected is kept in accordance with current legislation.\nThe Customer has the right to access, rectify, oppose and delete information concerning him or her by contacting contact@uneautrechambreparis.com.\n11.2. Telephone canvassingThe Customer accepts that L'Hôtel may collect his telephone data for the proper performance of the services. In accordance with the French law n°2014-344 of March 17, 2014, the Customer may register free of charge on the BLOCTEL telephone canvassing opposition list (www.bloctel.gouv.fr).\n11.3. Image rightsThe reservation of overnight stays and/or additional services in the establishment does not confer any right to audiovisual recording, filming or photography on the Hotel's premises, including rooms, for commercial, promotional, advertising or press relations purposes. Any filming or reproduction of the premises of the establishment for public purposes is subject to the prior authorization of the Hotel Management, under penalty of sanctions for counterfeiting, in accordance with the French Intellectual Property Code.ARTICLE 12: MISCELLANEOUS12.1. Applicable lawThese terms and conditions are governed by French law.\n12.2. Validity of provisionsIf one of the provisions of these conditions is declared null and void, it will be deemed unwritten, without affecting the validity of the other provisions.12.3. Non-smokingAll rooms are non-smoking. In the event of non-compliance, a cleaning charge of 80 euros will be billed to the Customer's credit card.\n12.4 Decorative objectsCertain decorative objects in the rooms may be purchased. If an item is taken away by mistake, the Hotel will charge the Customer's credit card, according to the rates available at reception.\n12.5. AccessibilityThe hotel does not have wheelchair access. For other handicapped situations, we invite customers to inform us of their needs at the time of booking.
